1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Blip Industries LLC ("we," "our," or "us") governing your access to and use of AeroStream, including our website, platform, software, services, and related applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use our Services. By using our Services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal authority to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and current

3. Account Registration

To access certain features of our Services, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

• Transmit any malicious code, viruses, or harmful software
• Attempt to gain unauthorized access to our Services or related systems
• Interfere with or disrupt the operation of our Services
• Use our Services to collect or harvest personal information about others

• Violate any drone regulations, airspace restrictions, or aviation laws
• Use our Services in a manner that could damage, disable, or impair our Services

5. Intellectual Property Rights

The Services, including all content, features, functionality, software, text, graphics, logos, icons, images, audio clips, and the design and arrangement thereof, are owned by Blip Industries LLC, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal or internal business purposes, subject to these Terms. This license does not include any right to:

• Resell or make commercial use of our Services
• Collect or use any product listings, descriptions, or prices
• Make any derivative use of our Services
• Use any data mining, robots, or similar data gathering tools

6. User Content

Our Services may allow you to upload, post, transmit, or otherwise make available content, including videos, images, data, and other materials ("User Content"). You retain ownership of your User Content, but by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with providing and improving our Services.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate any third-party rights
• Your User Content complies with all applicable laws and regulations
• Your User Content does not contain any harmful, offensive, or illegal material

We reserve the right to remove or disable access to any User Content that violates these Terms or is otherwise objectionable in our sole discretion.

7. Payment Terms

If you purchase any paid Services, you agree to pay all fees and charges associated with your purchase. All fees are stated in U.S. dollars and are non-refundable unless otherwise required by law or as specified in a separate agreement.

You are responsible for providing accurate payment information and authorizing us to charge your payment method for all fees. We reserve the right to change our pricing with reasonable notice. If you dispute any charges, you must notify us within 30 days of the charge.

8. Drone Operations and Regulatory Compliance

If you use our Services for drone operations, you are solely responsible for:

• Complying with all applicable federal, state, and local laws and regulations, including FAA regulations
• Obtaining all necessary licenses, permits, and authorizations
• Ensuring safe operation of drones and compliance with airspace restrictions
• Maintaining appropriate insurance coverage
• Respecting privacy rights and obtaining necessary consents for surveillance or recording
• Complying with data protection and privacy laws

We are not responsible for any violations of laws or regulations by users of our Services. You agree to indemnify and hold us harmless from any claims arising from your use of our Services for drone operations.

9. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• Our Services will be uninterrupted, secure, or error-free
• Defects will be corrected
• Our Services are free of viruses or other harmful components
• The results obtained from using our Services will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLIP INDUSTRIES LLC, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Blip Industries LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations
• Your User Content

12. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our Services will cease immediately.

You may terminate your account at any time by contacting us. All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Los Angeles County, California. You waive any right to a jury trial and to participate in a class-action lawsuit or class-wide arbitration.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our Services after such modifications constitutes your acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
